Who are we?

PropFundrs is a trading name for Pivot 23 Ltd.  Pivot 23 Ltd is a registered company in England and Wales (company no. 15281956).  Our address is 3rd Floor, 207 Regent Street, LONDON, W1B 3HH.  Pivot 23 Ltd operate the Website and we are the data controller for the purposes of the Act and the Regulation.

We are registered with the ICO to process your personal data and our registration number is ZB684517.

Your data will be processed by staff who work in the UK.  We have implemented appropriate security measures to prevent accidental loss, unauthorised access, or any alteration or disclosure of your personal data.  We will ensure that only authorised employees, consultants, agents, third parties and contractors have access to your data for the purposes stated in our Privacy Policy.   They will handle your personal data according to our directives, and they are bound by a confidentiality obligation.

Your data may also be transferred to locations outside the EU where the safeguarding criteria set out in Articles 44-50 of the GDPR are satisfied.

The PropFundrs website is hosted by Wix.com (see section "How do we store, use, share and disclose our site visitors' personal information?" below for further information).

Any payment transactions you make through our Website may be made through a third-party payment provider.  Any third-party payment provider may be a joint controller in respect of any personal data provided to them and any of your personal data they hold will be subject to their privacy policy.

What type of information do we collect?

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet Protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history.  We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page.  We also collect personally identifiable information (including name, email, password, communications), payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.

In addition to the above, we will also provide you with your Account Details, including your username (either created by or assigned to you). You are responsible for remembering the Account Details, but we will store them as a precaution in case you happen to forget.

How do we collect information?

When you interact with our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated.  The data listed could be collected in the following ways:

  • By you registering for an Account – this is any information you give to us that we request from you when signing-up for an Account to use our Website.

  • By you completing a form fill on our Website - this is any information you provide that we request from you when completing an action on our site.

We collect such Non-personal and Personal Information for the following purposes:

Your data is primarily necessary to verify who you are when accessing your account and to ensure you meet our eligibility requirements in order to submit a fundraiser application.  However, we will also use your personal data in the following circumstances:

  • Where we need to perform the contract, we are about to enter into or have entered into with you.

  • Where it is necessary for our legitimate interests (or those of a third party), and your interests and fundamental rights do not override those interests.

  • Where we need to comply with a legal obligation.

 

In most cases, we do not use consent as the primary legal justification for processing your personal information.  By registering for Account and/or otherwise using the Website, you expressly consent to:

  • provide us with the personal data necessary to allow you to use the Website;

  • the processing of your personal data by us, or those specifically listed third parties, in accordance with this policy; and

You have the right to withdraw consent at any time by contacting us. However, where the withdrawal of your consent prevents us from verifying your identity or otherwise monitoring who you are, you will be unable to use your Account through our Website OR you may exercise your rights at any time, which includes withdrawing your consent to our processing of your personal data.  However, where this withdrawal prevents us from performing our contract with you, we may not be able to provide our goods and services to you.

This is to enable us to refer back to any transactions or records you are involved in (should we be required to do so).

 

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Your data will also be stored within Click Up, as part of our process management software and Brevo, as our CRM/mailout provider.

We will only disclose your personal data to the following third parties for the following purposes:

  • any relevant Crowdfunding Marketplace Company – in connection with your application for funding;

  • our CRM, mailout and Process Management software, Brevo & Click Up - in order for us to effectively monitor applications, interact with our database and monitor website use;

  • our Website provider, Wix.com – to allow us to host our website effectively;

  • our affiliate companies/partners - to inform them which registered members from their database have registered via the affiliate link/landing page.

 

In addition to the transfers outlined above, we may transfer or disclose your personal data to:

  • any prospective buyer of any part of the relevant business or assets in connection with the sale (in which case, any personal data held by us about you and our Account Holders could potentially be one of the transferred assets);

  • comply with any legal obligation (such as where stated in our Terms of Use);

  • enforce or apply any part of our Terms of Use generally; or

  • protect our rights or our property, or those of our other Account Holders.

 

Any websites which are linked from the Website are outside of our control and not covered by this policy.  If you access those websites using any links provided, the website operators may collect information from you which will be used by them in accordance with their own privacy policies (if any exist). These policies may differ from ours, and we cannot accept any responsibility or liability in respect of these.

We have put in place appropriate technical and organisational measures to help protect your personal information from unauthorised access, use, disclosure, alteration or destruction consistent with applicable Data Protection Laws.  Each member of staff has unique log-in details and use authentication software to access the systems.  Staff have access to personal data only for the purposes of performing their roles.  We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

How do we communicate with you?

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our Terms of Use, applicable national laws, and/or any agreement we may have with you.  For these purposes we may contact you via email, telephone/mobile, text messages (inc. messaging apps such as WhatsApp), and postal mail.
